LOS ANGELES – In a significant regulatory shift, California’s cannabis industry is adapting to a new state law that imposes stringent rules on vape products. Effective as of July 1, the legislation introduces tougher packaging and disposal requirements for cannabis vape pens, targeting both environmental and public health concerns.

The New Law

The newly enacted law bans the use of the term “disposable” in the advertising, labeling, and marketing of marijuana vape products. All vape pens must now be labeled as hazardous waste and disposed of following strict protocols. This initiative is part of California’s broader strategy to curb the environmental damage caused by improper disposal of vape pens, which contain materials that pose significant risks if not managed correctly.

Industry Response

Cannabis companies throughout California are swiftly adjusting to meet these new regulations. Brands are redesigning their packaging to include clear disposal instructions and have launched take-back programs to facilitate proper disposal of used vape pens.

“This legislation will help educate customers on how to properly dispose of integrated vaporizers, highlighting the need to treat them as hazardous waste as opposed to normal waste,” said Angelica Sanchez of Perfect Union dispensaries, speaking with MJBizDaily’s Chris Casacchia.

Sanchez who is Senior Director of government Affairs and Compliance, dispensary, added “The Perfect Union team supports initiatives that promote both environmentally friendly packaging and safe disposal,” ultimately “This is an important step in the right direction.”

Environmental Impact

According to Andrew McGinty, owner and CEO of Cannabis Waste Solutions, cannabis vape pens contain lithium-ion batteries that can explode if disposed of in the trash. “Lithium reacts violently with water,” McGinty said, according to MSN. “If it’s thrown in the garbage there’s actually a lot of water in the garbage from other stuff decomposing. … Somewhere down the line … it is an explosion and fire hazard risk.”

By reclassifying vape pens as hazardous waste, California aims to mitigate the environmental footprint of the cannabis industry. This proactive step is expected to significantly reduce soil and water contamination from vape pen components.

Public Health Concerns
